Чи потрібен мені банер cookies? Відповідь за п'ять хвилин

Не кожному сайту потрібен банер cookies — але більшості потрібен, і багато з тих, що мають, все одно не відповідають вимогам. Практичний гід рішення.

The honest answer is: it depends on exactly two things — what your site loads, and where your visitors are. Everything else is detail. Walk through this in order.

Question 1: does your site set non-essential cookies?

You might be surprised. You need consent machinery if your site uses any of: an analytics tool (GA4, Matomo cloud, Plausible with cookies), an advertising or social pixel, embedded YouTube/Vimeo video, an embedded map, a chat widget, session replay, or A/B testing. You likely do not need a banner if your site is truly static — no third-party embeds, no analytics, only session/security cookies. That combination is rarer than people think; scan your site before you assume it.

Question 2: where are your visitors?

  • EU/EEA or UK visitors + non-essential cookies → you need an opt-in banner with prior-blocking. This applies regardless of where your company is based — the law follows the visitor.
  • Brazilian visitors → same opt-in posture under the LGPD.
  • California and a dozen-plus other US states → no opt-in banner required, but you must offer an opt-out and honor the GPC signal if you 'sell or share' data — and ad pixels count as sharing.
  • Only visitors from countries with no cookie law, and no plans to grow beyond them → legally you may not need one today; practically, analytics without borders doesn't exist.

The three ways sites get this wrong

  1. No banner at all while running GA4 and a Meta Pixel to EU traffic — the clearest violation and the easiest complaint for anyone to file.
  2. A decorative banner: it asks, but the trackers already ran on page load. Regulators treat this the same as no banner — see what prior-blocking means.
  3. A dark-pattern banner: bright Accept, buried Reject, pre-ticked boxes. EU regulators have issued specific fines for exactly this.

What a defensible setup looks like

  • A banner shown before non-essential cookies are set, with Accept, Reject, and per-category choice on equal footing.
  • Actual enforcement: scripts held until opt-in, embeds behind placeholders.
  • A persistent way to change the choice later.
  • A consent log you could hand a regulator: who (pseudonymously), what, when, which banner version.
  • Geo-awareness: opt-in where required, opt-out with GPC where that's the rule — see the worldwide law guide.
CookieCrumb gives you this stack in one script tag — scanner, banner, prior-blocking, and audit log, free for one domain. Five minutes to install; the scan tells you definitively whether you needed it.

So: do you need a cookie banner? If you have EU, UK, or Brazilian visitors and anything beyond strictly necessary cookies — yes, a real one. If you genuinely load nothing that tracks, no — and you'll be the fastest site on the internet. Run a scan and know for certain.
